Welcome to KanaMastery! These Terms of Service ("Terms") govern your use of the KanaMastery website located at kanamastery.com, our services, and applications (collectively, the "Service"). KanaMastery is operated from Portugal.

By accessing or using our Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service. These Terms constitute a legally binding agreement between you and KanaMastery.

To access certain features of the Service, you must create an account. You can register using:

• Email and Password: Create an account with your email address and a secure password. You must verify your email address before accessing all features.
• Google Sign-In: Authenticate using your existing Google account for faster access.

Account Security: You are responsible for maintaining the security of your account credentials. We offer Two-Factor Authentication (2FA) as an additional security measure, which we strongly recommend enabling. KanaMastery cannot and will not be liable for any loss or damage from your failure to maintain account security.

Account Requirements: You must be at least 16 years old to create an account. By creating an account, you represent that you meet this age requirement.

You may not use the Service for any illegal or unauthorized purpose. You must not, in the use of the Service, violate any applicable laws in your jurisdiction.

We reserve the right to refuse service, terminate accounts, remove or edit content, or cancel services at our sole discretion, particularly in cases of Terms violations, suspected fraud, or abusive behavior.

KanaMastery offers different membership tiers to suit your learning needs:

Subscription Management: Subscriptions (monthly and annual) automatically renew unless cancelled before the renewal date. You may cancel your subscription at any time through your account settings or the Stripe customer portal. Upon cancellation, you retain access until the end of your current billing period.

KanaMastery allows users to create custom quizzes ("My Quizzes") for personal learning and optional sharing with others.

Content Guidelines: When creating quizzes, you agree that your content:

• Does not infringe on any third-party intellectual property rights
• Does not contain offensive, discriminatory, or inappropriate material
• Does not contain spam, malware, or misleading information
• Complies with all applicable laws and regulations

Quiz Limits: Free users may create up to 3 quizzes with 30 questions and 30 answer options each. KanaMember subscribers may create up to 200 quizzes with 1,000 questions and 1,000 answer options each, with up to 50 tags for organization.

Public vs Private: You control whether your quizzes are public (shareable via link) or private (only accessible to you). Public quizzes may be played by other users.

Content Removal: We reserve the right to remove any user-generated content that violates these Terms or our content guidelines, without prior notice.

30-Day Money-Back Guarantee: We want you to be completely satisfied with KanaMastery. If you're not happy with your purchase for any reason, we offer a full refund within 30 days of your initial purchase date.

What's Covered: Our 30-day money-back guarantee applies to:

• First payment of KanaMember Monthly subscription
• First payment of KanaMember Annual subscription
• KanaMember Lifetime purchase

How to Request a Refund: To request a refund, please email us at [email protected] with your account email and reason for the refund request. We'll process your request within 5-7 business days.

Subscription Cancellations: You can cancel your subscription at any time through your account settings or the Stripe customer portal. When you cancel:

• You retain access until the end of your current billing period
• No further charges will be made after the current period ends
• Your learning progress and custom quizzes remain intact

Refund Processing: Approved refunds will be processed back to your original payment method. Please allow 5-10 business days for the refund to appear in your account, depending on your financial institution.

We reserve the right to deny refund requests that appear fraudulent or abusive. Multiple refund requests from the same user may result in account suspension or termination.

All payment processing is handled securely by Stripe, Inc. When you make a purchase or subscribe to KanaMember, your payment information is transmitted directly to Stripe and is never stored on our servers.

Information Shared with Stripe: To process your payments, we share the following information with Stripe:

• Your email address
• Your name (if provided)
• Purchase details (product, amount, currency)

This information is used solely for payment processing, fraud prevention, and providing customer support for payment-related inquiries.

By making a purchase, you agree to Stripe's Terms of Service and acknowledge that your payment information will be processed in accordance with Stripe's Privacy Policy.

Currency: All prices are displayed and charged in Euros (€). Your bank may apply currency conversion fees if your account is in a different currency.

You have the right to delete your account at any time. Account deletion can be initiated through your account settings in the dashboard.

Before Deletion: If you have an active subscription, you must cancel it before deleting your account. You can manage your subscription through the Stripe customer portal.

What Gets Deleted: When you delete your account:

• Your personal information (name, email, profile photo) is permanently removed
• Your learning progress and game history is deleted
• Your leaderboard entries are removed
• Your custom quizzes are permanently deleted
• Your authentication credentials are removed from Firebase

Data Retention for Legal Compliance: In accordance with tax and financial regulations, we may retain anonymized records of purchases for up to 7 years. This data is stripped of personal identifiers and cannot be traced back to you.

Confirmation: You will receive an email confirmation when your account has been successfully deleted.

KanaMastery features leaderboards that display user rankings based on XP earned and learning achievements.

Public Profile Setting: By default, your profile is set to private. You may choose to make your profile public through your account settings, which will display your username and scores on the public leaderboard.

Displayed Information: If you opt into public leaderboard participation, the following information may be visible to other users:

• Your display name (username)
• Your profile picture (if set)
• Your XP and level
• Your KanaMember status (premium badge)

Privacy Recommendation: We recommend using a pseudonym rather than your real name if you wish to maintain greater privacy while participating in leaderboards.

We reserve the right to remove or reset leaderboard data at our discretion, including but not limited to cases of suspected cheating, inappropriate usernames, or technical issues. Decisions regarding leaderboard data are final.

You agree not to use the Service to:

• Violate any applicable laws, regulations, or third-party rights
• Attempt to gain unauthorized access to the Service, other accounts, or computer systems
• Use automated scripts, bots, or other means to artificially inflate scores or manipulate leaderboards
• Share your account credentials with others or allow multiple people to use a single account
• Circumvent or attempt to circumvent any access restrictions or subscription requirements
• Upload or share malicious code, viruses, or harmful content
• Harass, abuse, or harm other users
• Create multiple accounts to abuse free tier benefits or evade account restrictions
• Scrape, copy, or redistribute our content without explicit permission
• Use the Service for any commercial purpose without our written consent

Violations of these rules may result in immediate account suspension or termination without refund.

KanaMastery may contain links to third-party websites, products, or services that are affiliates of KanaMastery ("Affiliate Links"). If you purchase a product or service through an Affiliate Link, KanaMastery may receive a commission or other compensation at no additional cost to you.

We only recommend products or services that we believe may be of value to our users learning Japanese.

KanaMastery will disclose the presence of Affiliate Links when required by law. The presence of Affiliate Links does not constitute an endorsement, guarantee, warranty, or recommendation by KanaMastery of those third-party websites, products, or services.

Third-party websites accessed through Affiliate Links have separate and independent privacy policies and terms of service. We have no responsibility or liability for the content and activities of these linked sites.

We collect data necessary to provide and improve our Service. For complete details on how we collect, use, and protect your information, please read our Privacy Policy.

Summary of Data Collected:

• Account information (email, name, profile picture)
• Authentication data (including 2FA settings if enabled)
• Learning progress, game history, and achievements
• Usage data and analytics to improve the Service
• Device and browser information
• Leaderboard data (username and scores, if public profile enabled)
• Marketing preferences

We do not sell your personal data to third parties. Your data is stored securely and used only for purposes related to providing and improving the Service.

We use Google Analytics to help us understand how our Service is being used. Google Analytics uses cookies, which are small text files placed on your device, to collect standard internet log information and visitor behavior information.

We also use essential cookies required for the Service to function, including:

• Session cookies for authentication
• Security cookies (CSRF protection)
• Preference cookies (theme settings)

You can opt-out of Google Analytics by installing the Google Analytics Opt-out Browser Add-on.

During account registration, you may opt-in to receive marketing communications from us. If you subscribe, we may use your email address to send you information about our Service, learning tips, updates, and promotions.

Our Content: All content provided on the Service, including but not limited to text, graphics, logos, images, audio clips, Japanese language data, quizzes, and software, is the property of KanaMastery or its content suppliers and is protected by international copyright laws.

Your License: KanaMastery grants you a limited, non-exclusive, non-transferable, and revocable license to use the Service for personal, non-commercial educational purposes.

Your Content: You retain ownership of any content you create (such as custom quizzes). By creating public quizzes, you grant KanaMastery a non-exclusive license to display and make available that content to other users.

Feedback: Any feedback, comments, or suggestions you provide regarding the Service is entirely voluntary, and we may use such feedback as we see fit without any obligation to you.

The Service is provided on an "as is" and "as available" basis. KanaMastery makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property.

Educational Content: While we strive for accuracy in our Japanese language content, KanaMastery is an educational tool and should not be relied upon as the sole source of language learning. We recommend supplementing your studies with other resources and native speaker interaction.

KanaMastery does not warrant that the Service will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

Limitation of Liability: To the maximum extent permitted by applicable law, in no event shall KanaMastery be liable for any indirect, incidental, special, consequential damages, or damages for loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising from your access to, or use of, the Service.

These Terms shall be governed by and construed in accordance with the laws of Portugal, without regard to its conflict of law provisions.

Dispute Resolution: Any disputes arising out of or relating to these Terms or the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be submitted to the exclusive jurisdiction of the courts of Portugal.

EU Consumer Rights: If you are a consumer in the European Union, you may also have rights under the laws of your country of residence, and nothing in these Terms affects your statutory rights as a consumer.

Online Dispute Resolution: The European Commission provides an Online Dispute Resolution (ODR) platform for EU consumers: https://ec.europa.eu/consumers/odr

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. Notice will be provided via:

What constitutes a material change will be determined at our sole discretion, but includes changes to pricing, data collection practices, or your rights under these Terms.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service and delete your account.
